[ARCHIVED] Bismarck City Commission to hold public hearings

Notice is hereby given that the Bismarck City Commission will hold public hearings on Tuesday, May 26, 2020, at 5:15 p.m. in the Tom Baker Meeting Room, City-County Building, 221 North 5th Street, Bismarck, North Dakota, to consider the following items:


•    Request of Benchmark Developments, LLC for approval of the annexation and a zoning change from the A – Agricultural zoning district to the R5 – Residential, R10 – Residential and RM10 – Residential zoning districts for Heritage Park Second Addition, a 96-lot subdivision on 35.77 acres.  The property is located in northwest Bismarck, north of 57th Avenue NW and east of 15th Street NW (part of the SW¼ of Section 8, T139N-R80W/Hay Creek Township).


•    Request of Benchmark Developments, LLC for approval of a zoning change from the A – Agricultural zoning district to the R5 – Residential and Conditional RT – Residential zoning districts for Heritage Ridge Second Addition, a 56-lot subdivision on 43.75 acres.  The property is located in northwest Bismarck, north of 57th Avenue NW and east of 15th Street NW (part of the SW¼ of Section 8, T139N-R80W/Hay Creek Township).


•    Request of Edgewood Properties, LLLP for approval of a zoning change from the PUD-Planned Unit Development zoning district to the R10 – Residential, RM30 – Residential and RT – Residential zoning districts for Edgewood Village Seventh Addition First Replat, a 52-lot subdivision on 40.95 acres.  The property is located in northeast Bismarck, west of Centennial Road and south of 43rd Avenue NE, just north of Legacy High School (a replat of Lots 1-3, Block 3, Edgewood Village Seventh Addition).


•    Request of the City of Bismarck for approval of a zoning ordinance text amendment relating to off-street parking and loading requirements.  The proposed amendment would amend Sections l4-02-03 (Definitions), 14-03-08 (Special Use Permits) and 14-03-10 (Off-street Parking and Loading) of the City Code of Ordinances. 


•    Request of the City of Bismarck for approval of zoning ordinance text amendment relating to the regulation of signs.  The proposed amendment would add Chapter 14-03.1 Signs to the City Code of Ordinances and repeal Chapter 4-04 Signs and Outdoor Display Structures and various sections from Title 14 pertaining to signs.


At these hearings, the Bismarck City Commission will provide an opportunity for all interested parties to be heard with respect to these items. Due to ongoing public health concerns related to COVID-19, the City of Bismarck is encouraging citizens to provide their comments for these hearings via email to bismarckadmin@bismarcknd.gov.  The comments will be sent to the City Commissioners and included with the minutes of the meeting. Please submit your written comments by 3:30 p.m. on the day of the meeting and reference the specific item your comment addresses, including the agenda item.  


Citizens may also appear via video or audio link for a 3-5-minute comment on any of these public hearing items by providing  e-mail address and contact information via email to bismarckadmin@bismarcknd.gov at least one business day before the meeting.
